Registration under The Building and other Construction Workers ( Regulation of Employment and Conditions of Service) Act, 1996

The service is available online on web portal www.hrylabour.gov.in. The system allows online application submission, payment, tracking and monitoring without the need for a physical touch point for document submission and verification. All applications are submitted online only. The system allows user to download final signed approval certificate online from the portal

For Fresh Registration
The user has to create a login id on web portal using operational email id and mobile number Project Report Fees Structure 30 days(Pursuance to the provisions stipulated under section 7 of BOCW Act, 1996, on receipt of the application alongwith required documents for registration of establishment from the Management on the website of Department i.e. http://www.hrylabour.gov.in. The application along with required documents at first instance will be dealt by the Assistant who will process the case well within 20 days. If all of the documents along with the application along with required documents found in proper order in accordance with the Scrutiny Sheet as well as Checklist, the Assistant, will further process the case to the Joint DIr, IS&H. If the application along with required documents not found in accordance with the provisions/checklist, objections have been raised online. After that Joint Dir, IS&H will go through the application along with required to see any discrepancies left at the level of Assistant. During scrutiny, if the application along with required documents found in accordance with the provisions/checklist the same will be approved and published. If, application along with required documents not found in accordance with the provisions/checklist the same application will be return to the management for the compliance for the observations. Total time for the entire process at the level of Joint Dir, IS&H has been given 10 days.) Checklist attached
After using his/her login ID , the user has to fill the basic information performa(BIP). This performa contains all the basic information of the establishment and occupier like address, number of workers etc. Article of Association / Memorundum of Association / Partnership Deed (only relevent pages)
The user will then have to fill Form I (system generated form) and provide relevant information List of Directors / Partners
The scanned copy of the documents should be legible and size of the document not to be more than 2 MB per document. Approval of Building Plan from Licensing / Local Authority.
Next step is to make fee payment. The fees is calculated on the basis of number of workers and date of license applied. User can make the payment via Online e-GRAS using Debit/Credit Cards CLU / Allotment Letter / posession letter,if any, from Licensing/Local Authority
However, user may also deposit this amount of the balance/pending fee in the old fashion of Treasury Challan but donot forget to upload its scanned copy immediately as a proof of fee payment. The system shall be keeping the logs of all the earlier submitted information in chronological order. Copy of agreement with Contractor / Builder for construction, if any
At the time of final submission, OTP (One Time Password) is sent to registered mobile number for verfication. Once verified, the application is submitted into the system for internal processing.
Internal processing: The application can be applied at the end user login; same application can be viewable at the Department officer login. The Department officer will check the application under (new/in process/marked/unpublished/observation/Reply) for BOCW Establishment Act application, & process the application via verifying the applicant document list under the scrutiny. The process flow for Department officer is explained below:
First level- The Assistant of the Factory Wing check’s the online application inside his login and comment online at the Departmental portal. The system will mark the application according to the category(e.g of Municipal Corporation, Municipal Councils, outside limits in rural areas ,All Hotels 3 star and above All Residential Building/ Houses of area upto 5, Acres,All Residential Buildings/ Houses above 5 acre and upto 15 acres , All Residential Buildings/Houses above 15 and upto 2) of the BOCW Establishment to the concerning Jurisdiction to the officer in Department. The same application will be marked to the second level officer (Deputy Director IS&H).-
Second level- The DDIS&H will review the comments of the assistant on the factory online application. If agreed on the comments of the Assistant of the Factory wing, the officer DDIS&H process the application & mark it to the JDIS&H(Joint Director).In case of the objection in the application the JDIS&H can generate the observation & publish it .The same observation can be viewable at the End user login & it can be replied via End user too.
Third Level- The Joint Director (IS&H) can review the same application and publish the BOCW Establishment License.
Scrutiny Process: The following are the list of the documents which can be scrutinizes at the process of the application by Department officers (Assistant,DD(IS&H),JD(IS&H):

Notice of Commencement
Once application is submitted, user can track the application by logging into the system using previously created login id. Any compliance related query / document can be submitted online during the process
After submission of the complete online application along with attachment and payment of statutory fees, the application gets automatically reflected in the account of the department officers/officials for scrutiny of the application and attachments.
The officers/officials(Assistant,DD(IS&H),JD(IS&H) during scrutiny process record his/her observations, if any, on the application and make known to the applicants via automatic generated e-mail and SMS. The observations are also visible to the applicant when he/she login to view the status of application.
The applicant can reply or make the compliance to these observations in the login panel of this e- service itself.
The officers/officials(Assistant,DD(IS&H),JD(IS&H) grant the registration certificate or amend it as the case may be if application is complete in all respect and applicant can download the certificate from his login.
Once application is approved, user can download the registration certificate online by loging into the system
For Amendment (in case there is change in no. of workers)
The user shall use the login credentials creating above to login into the already submitted application and submit amendement application by adopting the rest of the procedure explain above. Registration and Amendment of principal employer's establishment under provision of The Contracts Labour (Regulation and Abolition) Act, 1970

Principal Employer means in relation to any office or department of the government or local authority, the head of that office or department or such other officer as the government or the local authority, as the case may be, may specify in this behalf
In a factory, the owner or the occupier of the factory and where a person has been named as a manager of the factory under the Factories Act, 1948, the person so named in a mine, the owner or the agent of the mine and where a person has been named as the manager of the mine, the person so named. In any other establishment, any person responsible for the supervision and control of the establishment. An employer providing services for up keep of a building in any manner will be termed as contractor and will not be entitled for registration.
As per provisions of Section 7 of the Contract Labour (Regulation and Abolition) Act, 1970, every Principal Employer engaging 20 or more contract labourers in his establishment has to apply for registration of his establishment within 30 days.
The Labour Commissioner is the Registering Officer who will grant registration under the Act.
Procedure/Comprehensive list of Document(s) Required Fee Structure Mandated Timeline
For Fresh Registration
The user must have a valid registeration certificate under Shop Act (if covered under Shop & Commercial Establishment Act) or a valid Factory license if covered under Facroty Act. In case of a Government organization, user just has to fill basic information performa (BIP) Fees Structure 26 days(Breakup mandated timeline for registration of Principal Employer under the Contract Labour (Regulation & Abolition) Act, 1970 – Timeline 26 days.
(i) The applicant can make an online application only through the respective account of registration under the Shops and Commercial Establishments Act, 1958, in the case of service sector and the respective account under the Factories Act, 1948. However, for free flow working, the registration for engaging contract labour has been made possible even if the registration under the Factories Act, 1948 has not been approved. Therefore, examination of the application in reference to data at the back end needs to be given at least five days. (ii) If there is no objection, the application will be forwarded to the final authority for approval. However, in the case of objection communicated online the applicant have to be given five clear working days to rectify / clarify. (iii) On receipt of clarification / reply online, the branch is given five days to re-examine and to resubmit to the officer. (iv) The officer concerned is given five days to consider and recommend the approval and forward to the Registering Authority i.e. Labour Commissioner. (v) The Labour Commissioner is given to five days for allowing or objects to the application. (vi) Practically, the system is self stabilized and registration is being issued well within the stipulated time in about 20 days. )

The user (principal employer) has to provide details of contractor. If the contractor is from State of Haryana, then their BIP id will have to be provided by user (principal employer). In case the contractor is from outside Haryana, then their LIN number will be provided by the user user (principal employer) along with the number of workers and nature of work to be taken from them.
Next step is to make fee payment. The fees is to be paid on the basis of number of workers. User can make the payment via Online e-GRAS using Debit/Credit Cards

In case of the objection in the application the Additional Labour Commissioner can generate the observation & publish it .The same observation can be viewable at the End user login & it can be replied via End user too.
Third Level- The Additional Labour Commissioner can review the same application and mark the application to the Labour Commissioner for final approval.
The applicant can reply or make the compliance to these observations in the login panel of this e- service itself.
The related assistant grant the registration certificate or amend it as the case may be if application is complete in all respect and applicant can download the certificate from his login.
Once application is approved, user can download the registration certificate online by logging into the system
For Amendment Registration Certificate (Required in cases like adding new contractor, removing existing contractor or making changes in number of workes or change in nature of work for existing contractor)
The employer who desires to have registration certificate amended shall make an online application in Form No.1 to the above authority stating therein the nature of amendment required and reasons thereof.
